1. Who we are
kidzvivo ("we", "us") is operated by Elena Degtyareva, an individual sole trader. By using the service you agree to these terms and form a contract with Elena Degtyareva.
2. The service
kidzvivo helps families discover activities, save plans, generate AI itineraries, and book selected experiences around the Lake Geneva region. Free and paid (Premium) tiers are offered.
3. Acceptable use
You agree not to: (a) use the service unlawfully, (b) commit fraud or send spam, (c) infringe intellectual property, (d) interfere with security (malware, probing, scraping), (e) attempt to jailbreak or misuse the AI features, or (f) generate content that is illegal, harmful, deceptive, or violates third-party rights. You are responsible for your prompts, your use of AI outputs, and verifying their accuracy. AI outputs may be inaccurate and should not be relied on as professional advice.
4. Accounts
You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be of legal age to contract in your jurisdiction.
5. Intellectual property
We retain all rights in the service, software, branding, and content we provide. You receive a limited, non-exclusive, non-transferable right to use the service within your selected plan. No reverse engineering, resale, or circumvention of technical limits.
6. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refunds are governed by the Paddle Buyer Terms.
Premium subscriptions renew automatically at the end of each billing period until cancelled. Cancellation takes effect at the end of the current paid period; you keep access until then.
7. Service level
The service is provided "as is". We do not guarantee uninterrupted or error-free operation and disclaim all implied warranties to the fullest extent permitted by law.
8. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination your access ends and we may delete your data after a reasonable export window.
9. Liability
To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, except where liability cannot be excluded by law (e.g. fraud, death, personal injury).
10. Governing law
These terms are governed by Swiss law. Disputes are subject to the courts of the seller's jurisdiction unless mandatory consumer law provides otherwise.
